“The appellant has filed various documents in support of their appeal. The appellant filed these documents for the first time in this appeal. Though the writ court allowed the writ petition and the Division Bench dismissed the writ appeal, both decisions were rendered without examining these documents. In our view, these documents are material for disposal of the writ petition filed by the appellant.”
The Court emphasized that the lower courts had made conflicting rulings without fully considering the material evidence, making a fresh review necessary.
Judgment
The Supreme Court set aside both the Division Bench and Single Judge rulings and remanded the case back to the High Court for a fresh hearing. The writ petition was to be reconsidered with the liberty to file additional supporting documents.
Thus, the petition was allowed, and the case was remanded for fresh adjudication.
