Supreme Court Verdict on Criminal Appeals in Abduction and Rioting Case

The case before the Supreme Court involved two criminal appeals, Criminal Appeal No. 2147 of 2009 and Criminal Appeal No. 2295 of 2009, both of which were filed against the judgment passed by the Calcutta High Court in CRA No. 7 of 1991. The appellants, accused Nos. 1 to 5, 10, and 25, were found guilty under various sections of the Indian Penal Code.

The trial stemmed from an incident on October 9, 1983, in Karthnala village, where an altercation over cattle damaging crops escalated into a violent attack. The prosecution alleged that the accused, armed with deadly weapons, attacked the victim, Satyaban, and his friend Muralidhar Kuila, eventually abducting Satyaban, who was never found again. The trial court convicted seven accused while acquitting 28 others.

During the trial, multiple eyewitnesses, including family members and an independent witness, testified against the accused. The prosecution relied on medical reports, injury reports, and statements of witnesses to establish the charges. The Supreme Court upheld the conviction, emphasizing that the accused had a common object in abducting and attacking the victim. The appeals were dismissed.
