Supreme Court Upholds Pension Rights of Retired Banker Despite Late Application

The case of Oriental Bank of Commerce & Ors. v. Janak Raj Sharma addressed a crucial question regarding the eligibility of a retired bank employee for pension benefits despite a missed deadline. Janak Raj Sharma, the respondent, worked as a Senior Manager at Oriental Bank of Commerce and voluntarily retired on January 15, 2001. In 2010, the bank introduced a pension scheme for employees who had retired between September 29, 1995, and April 27, 2010. The last date to apply was set as October 25, 2010.

The respondent, however, was abroad when the circular was issued and only learned about it after the deadline had passed. He applied for pension benefits on November 18, 2010, but his application was rejected by the bank for being late. Feeling aggrieved, he approached the Punjab & Haryana High Court.

The bank appealed to the Division Bench, which upheld the Single Judge’s decision. Dissatisfied, the bank escalated the matter to the Supreme Court.

Supreme Court’s Observations

The Supreme Court, led by Justices R. Banumathi, A.S. Bopanna, and Hrishikesh Roy, ruled:

“In the normal course, adherence to deadlines in administrative matters is necessary. However, in exceptional circumstances, where the delay is due to genuine reasons beyond the control of the applicant, relief may be granted.”

The Court emphasized:

“The respondent had rendered long service to the bank and was abroad when the circular was issued. Denying him pension benefits due to a technical delay would be unjust.”

Final Judgment

The Supreme Court ruled:

  • The bank must accept the respondent’s pension application and process his pension benefits.
  • The respondent must return the provident fund contribution received upon retirement, with 6% interest, before receiving the pension.
  • The pension should be paid from the date of the Single Judge’s order (September 4, 2015).
  • No interest will be paid on the arrears from September 4, 2015, to the date of receipt.
  • The ruling is specific to this case and cannot be treated as a precedent for other similar cases.

Conclusion

This judgment reaffirms that while administrative deadlines must be adhered to, exceptions can be made in cases where fairness and equity demand it. The ruling ensures that employees are not unfairly deprived of their rightful benefits due to technical delays beyond their control.
