Stamp Duty Dispute: Ansal Housing vs. State of Uttar Pradesh

The case of M/S Ansal Housing and Construction Limited vs. State of Uttar Pradesh involved a significant dispute over the stamp duty payable on a tripartite agreement among the state, the developer, and the allottees.

Background of the Case

The core issue in these civil appeals, arising from SLP(C) Nos. 1012-1014/2012, was the liability of the developer and the allottees to pay stamp duty under Sections 33/47(A) of the Indian Stamp Act, 1899. The High Court of Allahabad had earlier ruled that full stamp duty must be paid, treating the agreement as a lease.

Arguments by the Petitioner

The counsel for the petitioner argued that:

  • The tripartite agreement was not a lease and should not be subject to full stamp duty.
  • The High Court overstepped its jurisdiction by adjudicating on the matter instead of leaving it to the competent authority.
  • The allottees were exempted from stamp duty.

Arguments by the Respondent

The State of Uttar Pradesh countered these claims by asserting that the nature of the agreement made it liable for stamp duty, and the High Court had appropriately adjudicated on the issue.

Judgment

Hon’ble Justice Kurian Joseph and Hon’ble Justice Rohinton Fali Nariman ruled that:

“In our view, bereft of the required materials before the High Court, the Court was not justified in adjudicating the issue at the first instance when there is a statutory scheme provided for adjudication of such issues by the competent authorities concerned.”

The Supreme Court set aside the High Court’s judgment and directed that the competent authority should decide the dispute. The authority was instructed to issue notices to the parties, hear them, and pass final orders within six months.

Conclusion

This case highlights the importance of following statutory procedures in taxation matters and the limitations of judicial intervention at preliminary stages.
