“Unless the intention to enter into such a contract is made public, there cannot be any transparency in the entering into that contract. The process of finalizing the contract being shrouded with thick blackness, the whole thing is bad.”

The Court upheld the High Court’s concerns regarding lack of transparency but directed the State to reassess the project execution.

Final Verdict

The Supreme Court disposed of the appeal with the following directions:

  • The contract arrangement between the Transport Commissioner and HILTRON was set aside.
  • The Uttarakhand government was directed to re-evaluate the Smart Card project and ensure a transparent selection process.
  • The appellant was permitted to seek remedies against HILTRON for any contractual disputes.

The appeal was disposed of with no order as to costs.
