Road Accident Conviction in Goa: Supreme Court’s Judgment on Rash Driving

“The well-reasoned order of conviction passed by the High Court for the offences under Sections 279 and 304A IPC needs no interference of this Court.”
However, the Court considered mitigating factors, including the fact that the appellant had already served more than seven months of his sentence, and had deposited a compensation amount of Rs. 3 lakhs for the victim’s family. The Court further noted:

“There was no allegation that the appellant was under the influence of liquor or any other substance impairing his driving skills. It was a rash and negligent act simplicitor and not a case of driving in an inebriated condition.”
Final Decision
The Court ruled that while the conviction stood, the sentence of imprisonment was reduced to the period already undergone. The fine imposed remained unchanged, and the compensation amount deposited by the appellant was directed to be transferred to the Motor Accident Claims Tribunal in South Goa for the widow of the deceased.
