Kerala Panchayat Department Promotions: Supreme Court Upholds Tribunal’s Ruling
The Supreme Court of India, in its judgment dated August 2, 2018, addressed the issue of irregular promotions in the Kerala Panchayat Department. The case, Abdul Jawad M.F & Anr. vs. R. “There cannot be any dispute on the factual scenario that all the 97 promotions were in excess of the eligible quota. There cannot also be any dispute on the fact that all the promotions given to the incumbents were ad hoc. Therefore, when a final seniority list is to be drawn up, a call has to be taken as to the fate of the ad hoc promotions.”
However, the Court also recognized the long years of service rendered by the affected employees and ruled that only two currently serving officers would be allowed to continue without reversion. Additionally, retired employees would not face any pension reductions.

The Supreme Court dismissed the appeals and directed the government to implement the Kerala Administrative Tribunal’s ruling. It also granted affected individuals the right to pursue further legal remedies if they had grievances arising from the implementation.
