K.R. Babu vs. State of Kerala – Seniority Dispute Case

The High Court ruled in favor of T. Raju, directing the State to revise the advice list and include him. However, the issue of his seniority arose due to the delay in his appointment following the advice.

The Supreme Court considered the nature of advice, which is issued by the Kerala Public Service Commission based on the merit list and principles of communal rotation. The actual appointment, however, depends on various factors such as distance, availability, and the time it takes for the appointing authority to issue the order. The Court emphasized that seniority should be determined by the date of the first effective advice issued for appointment, and not the date of joining or appointment.

After reviewing the case, the Court concluded that T. Raju should be considered for appointment from the next available vacancy and that his seniority would be fixed based on the effective date of advice, which was after the last advice issued in 1998. This ensured that the appointments and promotions of the already appointed individuals would not be disturbed, and the seniority of T. Raju was determined accordingly.

Throughout the judgment, the Court reiterated the distinction between advice and appointment, as well as the importance of maintaining the integrity of the seniority list while ensuring that T. Raju’s rightful place in the list was recognized. It is noteworthy that the Court also directed that the benefits of this revision would be notional in terms of monetary benefits, with the revised seniority not affecting any previously appointed candidates.

Furthermore, the Court clarified that the revision of seniority would not lead to any reversion of candidates already in position, and any such reversion would be deferred until T. Raju’s retirement. This decision came in light of the fact that T. Raju had only eight months left in service at the time of the ruling. The Court also set a deadline for the implementation of this decision, requiring the State to provide the appropriate promotions and appointments within one month from the date of the judgment.

In conclusion, the Court dismissed both appeals filed by the State and K.R. Babu, while ensuring that the benefits of this ruling applied only to the peculiar facts of the case.
