The Supreme Court, comprising Justices Kurian Joseph and R. Banumathi, heard the appeal filed by Noor Nagar Ext. Welfare Association. The appellants contended that since the Division Bench allowed fresh proceedings, I.A. No. 17544 of 2011 should also be revived for consideration.
The Supreme Court agreed and held that:
- The application under Order VII Rule 11 CPC, I.A. No. 17544 of 2011, would stand revived.
- Both parties were allowed to amend their pleadings and present fresh arguments before the High Court.
