Decades-Long Family Property Dispute Settled by Supreme Court
For over four decades, the family of late Nand Singh had been embroiled in a legal battle concerning the division of inherited property. The case, which had been pending for more than a decade in the highest court, saw a resolution thanks to mediation and judicial intervention.
Background of the Case
The case involved the legal representatives of Gurbachan Singh and Gurdial Singh, both of whom were heirs to the property of the late Nand Singh. The dispute primarily revolved around the rightful ownership and demarcation of 132 Kanals of agricultural land.
Supreme Court’s Observations
Recognizing the possibility of settlement, the Supreme Court facilitated an agreement between the parties. The court directed the Tehsildar of Samrala District, Ludhiana, to demarcate 44 Kanals of land to be allocated to the legal representatives of Dhan Kaur, the deceased daughter of Nand Singh.
The court emphasized the importance of an amicable settlement, stating, “It is in the interest of the parties, at least in the third generation, that the litigation should be given a quietus.”
Final Settlement and Court Directives
The Tehsildar prepared a report detailing the equitable division of land. The Supreme Court, after reviewing the report, upheld the allocation and directed its implementation.
Additionally, to ensure fairness, the court acknowledged that the respondents lacked a water source for irrigation. It granted them the right to seek necessary permissions for installing a tubewell and instructed the Electricity Board to expedite power connection if the request was approved.
Appreciation for Mediation Efforts
The Supreme Court lauded the efforts of senior counsel Maninder Singh, who played a pivotal role in mediating the settlement. The court also recommended an appreciation entry in the Annual Confidential Report (ACR) of Tehsildar Navdeep Singh Bhogal for his diligent work in resolving the dispute.
Conclusion
By settling the property dispute amicably, the Supreme Court not only provided closure to the litigants but also set a precedent for resolving prolonged family feuds through mediation and equitable judicial decisions.
