Arbitration Award Upheld: Supreme Court Rules in Favor of Sutlej Construction
The Supreme Court of India recently delivered a significant judgment in the case of Sutlej Construction vs. Union Territory of Chandigarh. The dispute arose over a construction contract awarded to the appellant, Sutlej Construction, which was later terminated by the respondent, the Union Territory of Chandigarh. The case involved a contract for excavation and transportation of earth for the widening of the approach road to Sukhna Choe on Chandigarh-Kalka Road. The arbitrator, Mr. R.N. Singal, a retired District & Sessions Judge, ruled in favor of the appellant, awarding a sum of Rs. 10,37,185 along with an interest of 12% per annum. The respondent’s counterclaims were rejected.

The Union Territory of Chandigarh challenged the arbitration award under Section 34 of the Arbitration & Conciliation Act, 1996, before the Additional District Judge, Chandigarh, who dismissed the objections. However, the Punjab & Haryana High Court overturned the arbitration award, ruling that the contract’s termination was justified.
In response, the appellant moved the Supreme Court, arguing that the High Court improperly reappreciated the evidence and overstepped its jurisdiction.
Supreme Court’s Observations
The Supreme Court, in a judgment delivered by Justice J. Chelameswar and Justice Sanjay Kishan Kaul, ruled in favor of Sutlej Construction. The Court observed:
“An arbitrator is a chosen Judge by the parties and it is on limited parameters can the award be interfered with.”
The Court held that the High Court erred by re-evaluating the evidence, which was not permissible under arbitration law. The arbitrator’s decision was based on reasonable interpretations of contractual obligations, and thus, interference by the High Court was unjustified.
Final Verdict
The Supreme Court set aside the High Court’s ruling and reinstated the arbitration award. The appeal was allowed, and the respondent was directed to comply with the award’s terms.
