Compensation and Market Value Determination in Land Acquisition Disputes

He noted that the issue of market value had already been conclusively decided, and there was no justification for reopening the matter. The judgment at paragraph 105 of the High Court’s decision clearly stated that the market value had been determined at Rs. 65 per square yard, and this had been upheld by the Supreme Court in previous appeals.
The Supreme Court’s decision, therefore, was to allow the appeals, fixing the market value at Rs. 65 per square yard. Additionally, the appellants were entitled to all statutory benefits associated with the compensation for land acquisition. The Court made it clear that no further proceedings were necessary, as the matter had already been definitively settled.
In conclusion, the Supreme Court emphasized that the finality of the market value determination, along with the statutory benefits, rendered the remand of the matter unnecessary. This judgment reinforced the principle of finality in compensation matters, ensuring that previously settled disputes in land acquisition cases are not revisited without valid reasons.
