Supreme Court Dismisses Review Petition in Mysore Urban Division Case
The Supreme Court of India recently delivered a judgment in the case of L. Narasimhaiah vs. The Divisional Controller, Mysore Urban Division. This case was brought before the Court as a Review Petition (Civil) No. [Diary No. 10074 of 2022], arising from Special Leave Petition (Civil) No. 27074 of 2016.
The Court first addressed the procedural aspect of the review petition. The delay in filing the Review Petition was condoned, indicating that the Court permitted the petition to be considered despite the late submission.
However, the application for listing the Review Petition in an open court was rejected. This means that the case was heard and decided by the bench in chambers rather than being presented for oral arguments in open court.
The Court examined the merits of the petition and reviewed the previous decision made in the Special Leave Petition (SLP). After considering the submissions of both parties and the factual background, the Court concluded that the grounds raised in the Review Petition did not demonstrate any ‘error apparent on record’—a legal standard that must be met for a review petition to succeed.
Consequently, the Supreme Court dismissed the Review Petition, affirming the decision made earlier in the Special Leave Petition.
This judgment was delivered by a bench comprising Chief Justice Uday Umesh Lalit, Justice Ajay Rastogi, and Justice Aniruddha Bose on November 1, 2022, in New Delhi.
The case underscores the stringent standards applied by the Supreme Court when reviewing its prior decisions. Unless there is a clear and manifest error on the face of the record, the Court is reluctant to interfere with its previous rulings through review petitions.
