“The Central Government was bestowed with the duty to amend Schedule-II in view of Section 163-A(3) of the Motor Vehicles Act, but it failed to do so. The notional income of Rs.15,000 per annum as prescribed in 1994 is outdated and does not reflect current economic conditions.”

Based on this, the Court revised the compensation as follows:

  • Increased the notional income of the deceased from Rs.15,000 to Rs.25,000 per annum.
  • Applied the multiplier of 15, as prescribed in Schedule II for non-earning persons.
  • Enhanced the total compensation to Rs.4,70,000, including:
    • Loss of Dependency: Rs.3,75,000
    • Filial Consortium: Rs.80,000 (Rs.40,000 each for both parents)
    • Funeral Expenses: Rs.15,000

The Court also ruled that the insurance company must pay the compensation amount to the claimants and could recover the sum from the motorcycle owner, as the driver did not possess a valid driving license at the time of the accident.
