Land Acquisition in Kerala: Supreme Court Enhances Compensation for Wetland Owners
The case of K.S. Rajan (D) through LRs vs. The State of Kerala & Anr. involved a long-standing dispute over land acquisition compensation in Kottayam, Kerala. Background of the Case
The State of Kerala issued a notification on 25th November 1980 under Section 4 of the Land Acquisition Act, 1894, acquiring approximately 30 acres in Kottayam Municipality for the ‘multipurpose development scheme at Kodimatha.’ The landowner, K.S. Rajan, owned 4.30 acres, which was also acquired.
The Land Acquisition Officer (LAO) initially determined the compensation as follows:
- Dry Land: Rs. 4,631 per cent
- Chira Land: Rs. 1,725 per cent
- Wet Land: Rs. 203 per cent
Dissatisfied with this valuation, the landowner sought reference to the Civil Court, which increased the compensation to:
- Dry Land: Rs. 7,500 per cent
- Chira Land: Rs. 2,000 per cent
- Wet Land: Rs. 2,000 per cent
The State appealed to the Kerala High Court, which remanded the matter for fresh determination. The Reference Court, upon reconsideration, revised the compensation as follows:
- Dry Land: Rs. 5,000 per cent
- Chira Land: Rs. 2,500 per cent
- Wet Land: Rs. 450 per cent
The landowner appealed again to the High Court, which made a minor modification, increasing the compensation for Wet Land to Rs. 500 per cent. Dissatisfied with this, the landowner moved the Supreme Court.

Landowner’s Argument
- The compensation for Wet Land was disproportionately low compared to Dry Land and Chira Land.
- The Reference Court, in another case, had awarded Rs. 2,000 per cent for similar Wet Land acquired in the same proceedings.
- The principle of parity should be applied, and the landowner should receive the same compensation as others with identical land.
State’s Stand
- The compensation determined by the High Court was fair and based on market rates.
- The Reference Court’s previous ruling in another case should not apply automatically.
- There was no reason to enhance the compensation further.
Supreme Court’s Verdict
The Supreme Court ruled in favor of the landowner, noting that compensation for similar Wet Land had been fixed at Rs. 2,000 per cent in another case arising from the same acquisition proceedings. The Court observed:
“The appellants’ land and the other landowners’ land, which were awarded higher compensation, are identical in all respects. Therefore, they are also entitled to claim compensation at the same rate.”
Accordingly, the Court modified the compensation for Wet Land to Rs. 2,000 per cent, bringing it in line with the previous award.
The Court further stated:
“The award of Rs. 2,000 per cent for Wet Land appears just, proper, and reasonable, keeping in view the nature of the land, its surroundings, and similarity with other land acquired in the same proceedings.”

This ruling reinforces the principle of equal treatment in land acquisition cases. It ensures that landowners receive fair and consistent compensation for properties with similar characteristics. The judgment also underscores the importance of maintaining parity in compensation to prevent arbitrary valuation.
